Changeqr.com Terms and Conditions

These Terms and Conditions affect the rights and obligations of the 'Buyer' and the 'User' and determine the conditions under which Changeqr (the 'Supplier') makes products available to the Buyer through the Changeqr website.

1. Purchases Made Using the Changeqr Website

The basis of the contract between the Buyer and the Supplier is established as follows:

The “Buyer” places an online order for a Changeqr “User Account” and/or “Products” by completing the ordering process at the checkout point on the Changeqr website.

Delivery and Packaging charges may apply and are subject to quotes valid at the time of ordering.

The 'Buyer' will receive an order confirmation containing details of the Products ordered. This is not an order confirmation and does not constitute acceptance of the 'Buyers' order by the 'Supplier'.

Following dispatch of the "Products", the "Buyer" or its designated "User" receives an order and shipping confirmation together with the "Products". Acceptance of the order and completion of the contract between the 'Supplier' and the 'Buyer' is effected by dispatch of the ordered Products. Exceptions include the 'Supplier' notifying the 'Buyer' that it does not accept the order or that the 'Buyer' cancels the order.

Before paying for a "User Account" and/or "Products", the "Buyer" must confirm that he/she accepts the "Terms and Conditions", including the "Supplier" "Privacy Policy".

1.1 Online Payments

Changeqr products can be purchased by the 'Buyer' and will be processed through the 'Supplier' e-commerce payment system. This payment method ensures the security of the "Buyer" because the merchant service facility assumes full responsibility for the security of the "Buyer's" credit/debit card information.

Processing of the acceptance of the order and completion of the contract between the 'Supplier' and the 'Buyer' will only take place after the order is accepted and the credit/debit card transaction is verified by the merchant service.

Ordered "Products" will normally be dispatched within 5 business days after "Order Confirmation". In the case of 'special orders', i.e. products made to order, shipment will normally occur within 10 working days after 'Order Confirmation'.

2. Payment

The total cost of the "Buyer" order is the "Price" of the "User Account" registration and/or the "Products" ordered plus the delivery and packaging costs specified at the time the "Buyer" places the order.

Payment by most credit and debit cards is acceptable.

Credit/debit card payment will be processed when the 'Buyer' places an order and the 'Supplier' confirms the order.

All card payments are processed by the "Supplier's" Merchant Services Facility provider for a commission fee included in the "Buyers" purchase cost.

3. Delivery

Delivery will be made to the address specified by the 'Buyer' at the time of order and detailed in the 'Supplier' 'Order Confirmation'.

Delivery of products is generally effected within 5 working days from the date of the order confirmation email. Delivery time will be longer for 'Personalised' or made-to-order 'Products'. "Supplier" shall not be liable to "Buyer" for any loss resulting from delay in delivery.

Delivery charges applicable to 'Buyer's' order will be stated at the time of purchase and when 'Buyer' is asked to confirm their order.

4. Pricing and Pricing

The Fees and Prices to be paid for the 'User Account' and/or 'Products' ordered are detailed on the Changeqr Website. If by mistake the detailed Fees and Prices are incorrect, the 'Supplier' shall not be obliged to supply that product to the 'Buyer' at the stated price, provided that the 'Supplier' notifies the 'Buyer' prior to dispatch.

All prices stated on the website include VAT at the current rate.

If the "Prices" need to be changed due to circumstances beyond the "Supplier's" control, including any change in the rate of VAT to be paid, the "Buyer" will be informed and requested to reconfirm the order at the changed "Price".

5. Product Availability and Status

The purchase of the ‘User Account’ registration and/or ‘Products’ displayed on the Changeqr website is subject to availability and the ‘Supplier’ shall not be liable to the Buyer in the event that the ‘Supplier’ is unable to supply the ‘User Account’ registration and/or ‘Products’ to the ‘Buyer’.

In case a "Product" is not available after the "Order Confirmation" the customer is offered the following options:

alternative product, changed delivery date, full refund

"Supplier" assumes no responsibility for "Individuals'" awareness, understanding or ability to access or act on information about the "Products" or "Service" or within the "User Account".

In cases where the 'User' records critical personal information or medical details, the 'Supplier' recommends the use of a combination of iD 'products' to assist with visibility and accessibility by 'individuals'.

The "User" is responsible for ensuring that their "product" is usable and readable, including the readability of the engraved or printed information, QR code and PIN.

6. Services

6.1 Scope of Services

All “Supplier” “services” are provided by Changeqr. 'Services' includes access to the Changeqr website and web pages, including:

'User Account' named 'My Account' on Changeqr.com Public pages for 'Users'

6.2 Service Availability

Service availability of the Changeqr website and 'User Account' will require:

Internet access using a suitable web browser

Internet access availability – 'Supplier' does not warrant that internet access is available from the 'Buyer', 'User' or 'Persons' internet service provider.

Website availability - The Supplier does not guarantee the availability or accessibility of the "Supplier's" website.

QR Code Scanning/Reading - In order to scan or read a Quick Reference Code (QR Code), the 'User' will require a suitable device which may include a Smartphone with a suitable QR reader/scanner App etc.

6.3 Service Period

Those who purchase 'Supplier' products that can be linked to an online account are provided with access to the Changeqr website and this account for a minimum of 2 years.

During this period, access to the "User" "User Account" and public pages of the Changeqr website accessed by "Individuals", including data services (and their members) used on the site, is "free".

'Re-registration' administration fees may apply at the discretion of the 'Supplier' after 2 years from the date of purchase. 'Re-registration' ensures that the 'User Account' remains active and visible and accessible for updates and modifications by the 'User'.

6.4 Service Content

'User' is responsible for the entire content of 'User Account' and 'Product'.

7. Cancellation

 The 'Buyer' has the right to cancel the 'Registration' and/or 'Products' order by contacting the 'Supplier' by email at changeqrcode@gmail.com up to 24 hours from the order date of the products  .

If the "Products" were shipped to the "Buyer" before the order cancellation was notified to the "Supplier", the "Supplier" must return all "Products" in accordance with the Return procedure below.

During "re-registration", the "User"   may cancel the "Service" by contacting the "Supplier" via email at changeqrcode@gmail.com .

8.Refund

If for any reason the "Buyer" needs to return the "Products" to the "Supplier", the "Buyer" must do so within 14 days from the date of delivery. To return any product to the 'Supplier' the following procedure must be followed:

Keep the product in its original packaging and in its original condition; Contact the seller and return the product to the address given. Please pay attention to the following points regarding returns.

All 'Products' must be returned to the 'Supplier' in an unused and sold condition. If the 'Product' is returned in a condition that makes it unfit for resale, the 'Supplier' reserves the right to refund part or all of the 'Price';

The Supplier will not be responsible for non-receipt of the returned 'Products'.

Upon receipt of the returned "Products" by the "Supplier", an appropriate proportion of the "Price" will be credited to the Buyer's credit/debit card within 10 business days from receipt.

9. "First Changeqr User Account Registration"

The User's initial Account 'Registration' is as specified in the 'Order Confirmation'. It enables the online registration of purchased 'Products' to the Changeqr User Account in order to ensure the online visibility of the 'User Account' information, which can be used for various purposes.

A 'Registered' 'User Account' will remain active for a specified period of time as set out in the 'Terms and Conditions' at the time of purchase or re-registration or, where applicable, in the 'Order Confirmation'. The specified 'Registration' is provided after purchase and only when the purchased 'Products' or 'Services' are activated and a 'User Account' is registered in the Changeqr system.

10. Changeqr 're-registration' fee

Changeqr The 'User' will be notified when 're-registration' is required.

If the 'User' wishes to 'Re-register' the then current fee will be charged.

The 're-registration' fee is an administration fee only and is non-refundable.

Once a 'Re-registration' fee has been paid, all subsequent services or access to the Changeqr record are free for the duration of the 'Re-registration' period.

A single 'Re-registration' fee automatically covers all previously registered 'Products' in use by the 'User'.

 

It is the responsibility of the 'Registered Account Holder' to ensure that their 'Registered Account' remains active.

 

11. Legal Notice

This Online Purchase Policy includes the terms set out in the Legal Notices and User's acceptance of the Online Purchase Policy constitutes User's acceptance of the Legal Notice.

Privacy Notice

At Changeqr we are committed to protecting your privacy. The following Privacy Policy sets out how we use and protect the information you provide to us.

By accessing or using the Changeqr website, you agree to the terms of the Changeqr Privacy Policy set out below. If you do not accept these terms, please do not access or use this site.

Changeqr reserves the right to change its Privacy Policy from time to time in its sole discretion. Your use of this site will be subject to the most current version of the Privacy Policy at the time of such use.

Your personal information

Why do we collect your personal information?

'Supplier' collects your information for the following purposes:

'Buyer' information to process, ship and inform 'Buyer' about 'Supplier' products and services. We take 'Buyer' privacy very seriously and require that we store your personal data so that we can keep you informed about your order status and products and services. If you do not allow us to do this, we will not be able to keep you informed about the status of your order or any significant changes to our products or services and therefore we will not be able to receive your order.

'User' information for informing 'User' about products and services and information entered by 'User' into 'User Account'. We take 'User' privacy very seriously and request that we retain your personal data to inform you about your products and services and to provide 'emergency information' through the 'User Account' web pages. If you do not allow us to do this, we will not be able to provide your 'emergency information' on the 'User Account' web pages and we will not be able to inform you about any changes to our products or services.

What information do we collect?

We typically collect:

'Buyer' - When 'Buyer' purchases products, the email address and password for the product

'User' name and email address. When the 'User' Activates their 'User Account' and uses 'My Account' to register details with Changeqr, order 'Products' or  register with us at www.Changeqrid.com (the 'Website'), you will be provided with the following information: your name , the opportunity to enter certain information such as your email address, contact phone numbers, date of birth, images, documents, 'Products' selections and other personal data. The data in the "User Account" is stored by the "Supplier", but maintained, added or deleted by the "User". 'Supplier' only stores name and contact information and any 'emergency information, internet social media addresses (referring url-website names) and images' on the 'User Account' are managed by the 'User'.

By default, you will also be provided with information about your use of our website (for example, the URL you came from, your IP address, your browser type and the pages on our website viewed during your visit) ("Your Information"). This is stored anonymously and may be used for web traffic analysis.

What will we do with your personal information?

Changeqr recognizes and appreciates the importance of responsible use of information collected through the Changeqr website.

The information we collect, store and process will be used to provide you with Changeqr services and to improve our business (without limitation):

fulfillment of a 'Buyer' order

'Emergency information' entered and maintained by the 'User' to access your personal data in an emergency will be stored in the 'User Account'. On the website, details in public areas of 'My Account' are visible to anyone as you enter your unique URL.

to verify your identity (for example, when you return to the Website);

personalize your visits to the Website to improve the services provided to you;

provide customer service and support;

to enable you to share your content with others, for example by emailing a friend and using the social network sharing function;

to communicate with you (and personalize that communication);

to analyze web traffic to measure the performance of our services and the Website.

We may sometimes contact customers by email, postal mail or telephone using information provided during registration or order placement. Customers,   you can contact us at changeqrcode@gmail.com .

Using your information to communicate with you

In addition to our typical processing, we may use the information we hold about you to contact you in the following situations:

How long do we keep it?

We do not keep your information for longer than necessary to provide the service and to ensure that we have appropriate auditable records for business purposes.

Whenever we collect or process your personal data, we only store it for as long as necessary for the purpose for which it was collected. At the end of this storage period, your data will either be completely deleted or will be anonymized, for example by combining it with other data so that it can be used in a non-identifiable form for statistical analysis and business planning.

Orders - When you place an order we will retain the personal data you provide to us for 10 years so that we can comply with our legal and contractual obligations.

User Accounts – 'User Account' information will be stored for as long as you need it.

Deactivating Your User Account - If you wish to deactivate your 'User Account', you can contact Changeqr and we can deactivate the account. We retain the data you enter for deactivation to enable you to reactivate the account without having to re-enter your personal data into your 'User Account'.

User Account Closure - If you would like Changeqr to close your 'User Account', please contact Changeqr and we will close the account and delete or anonymise the personal data associated with it.

Third Party Suppliers - 'Third Parties' retain data only for the duration of the production period of the ID products and for a maximum of 14 days.

With whom will we share your personal information?

For 'Users', all public areas of the 'User Account' Website   are publicly accessible using your unique URL , for example www.Changeqr.com/youruniqueid .

Your password 'Protects access to all data details in your account. You must protect your password. 'Users' may retain, add or delete data in their 'User Account' at any time.

By registering 'My Account' with Changeqr or placing an order on the Changeqr website, customers confirm that the use of the information described above is not considered a violation of any of the rights granted under 'Data Protection'. Legislation'.

Changeqr uses a Merchant Services Facility and does not keep records of credit/debit card details.

Disclosure of Information to Third Parties during Order Production

For “Recipients” we provide your information to approved third parties who engrave or print “User” personalized ID products. The data is deleted after production is completed.

Changeqr does not provide, sell or rent your information to any third party, but reserves the right to provide aggregated anonymous data to third parties for statistical analysis. Such data is anonymous in nature and cannot be linked to any specific person.

We will not disclose your information to third parties without your consent, unless legally required to do so or where such disclosure is necessary to enable third parties acting for us to process your order. Third parties that process information, fulfill and deliver orders, process credit card payments and provide support services do so on our behalf under individual contracts.

If we use 3rd parties to run our business processes. An example of this would be hosting our emails or our website and database in the cloud. Although these cloud providers do not usually have direct access to your information, storage is considered processing under relevant data protection legislation.

If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or to enforce or apply our terms of use, which includes exchanging information with other companies and organisations for fraud protection purposes.

Secure collection and storage of your information

Any information you provide to us or that we collect about you is stored on our secure servers. We understand that this contains confidential information and we have put in place a number of appropriate physical, electronic and managerial procedures to safeguard and secure your information.

Our staff have the minimum required access to your data and are trained to ensure it is protected and kept secure. Unfortunately, the transmission of information over the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to us; Any transmission is at your own risk. Once we receive your information, we will use strict procedures and security features to attempt to prevent unauthorized access.

We do not keep your information for longer than necessary to provide the service and to ensure that we have appropriate auditable records for business purposes.

We take security measures to protect customer information and personal data against unauthorized access and unlawful processing, accidental loss, destruction and damage. However, although we take all reasonable steps to protect customer information, customers acknowledge that no Internet data transmission can be guaranteed to be secure from access by unintended recipients and customers will not hold us liable for any breach of security unless caused by our negligence.

Your rights

You have the right to request that we access your personal information. This is sometimes known as a 'subject access request'. In addition, you have the right to request from us:

Law and Jurisdiction

This privacy information notice is subject to the laws and jurisdiction of the REPUBLIC OF Türkiye. All liability for use in other countries belongs to the user.

INFORMATION TEXT ON THE PROCESSING OF PERSONAL DATA

This Information Text has been prepared to provide clarification regarding the processing of personal data by the Company within the scope of the Personal Data Protection Law No. 6698 ("Law").

1.a) Methods of Obtaining Personal Data and Legal Reasons

Your personal data is collected in electronic or physical environment. Your personal data collected for the legal reasons specified in this Disclosure Text can be processed and shared within the framework of the personal data processing conditions specified in Articles 5 and 6 of the Law.

  1. b) Purposes of Processing Personal Data

Your personal data, planning and execution of the activities required to recommend and promote the products and services offered by the Company to the relevant persons by customizing them according to the tastes, usage habits and needs of the relevant persons within the framework of the personal data processing conditions specified in Articles 5 and 6 of the Law, Carrying out the necessary work by the business units and carrying out the relevant business processes in order to benefit the relevant people from the products and services, Carrying out the necessary work by the relevant business units to realize the commercial activities carried out by the Company and carrying out the related business processes, Planning the commercial and/or business strategies of the Company. and execution, and to ensure the legal, technical and commercial-occupational security of the Company and the relevant persons who have a business relationship with the Company.

  1. d) Rights of Data Owners and Exercise of These Rights

If you, as personal data owners, submit your requests regarding your rights specified below to the Company using the methods specified under the heading Exercise of Rights by Data Owners, your requests will be evaluated and finalized by our Company as soon as possible and in any case within 30 (thirty) days.

Pursuant to Article 11 of the Law, as a personal data owner, you have the following rights:

  • Learning whether your personal data is being processed,

  • Request information regarding your personal data if it has been processed,

  • To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,

  • To know the third parties to whom your personal data is transferred, either domestically or abroad,

  • To request correction of your personal data if it is processed incompletely or incorrectly and to request notification of the action taken to third parties to whom personal data is transferred,

  • Requesting the deletion or destruction of your personal data in case the reasons requiring processing no longer exist, even though it has been processed in accordance with the law and other relevant legal provisions, and requesting that the action taken in this context be notified to third parties to whom personal data has been transferred,

  • To object to the emergence of a result against the person by analyzing your processed data exclusively through automatic systems,

  • To request compensation in case of damages due to unlawful processing of your personal data.

  • The second paragraph of Article 28 of the Law lists the situations in which data owners do not have the right to request, and in this context;

  • Processing of personal data is necessary for the prevention of crime or criminal investigation,

  • Processing of personal data made public by the relevant person,

  • Personal data processing is necessary for the execution of supervisory or regulatory duties or disciplinary investigation or prosecution by authorized public institutions and organizations and professional organizations with the status of public institutions, based on the authority granted by law.

  • Personal data processing is necessary to protect the economic and financial interests of the State in relation to budget, tax and financial matters,

  • In such cases, the rights specified above cannot be exercised regarding the data.

  • According to paragraph 1 of Article 28 of the Law, in the following cases, since the data will be outside the scope of the Law, the requests of data owners will not be processed in terms of these data:

  • Processing of personal data by real persons within the scope of activities related to themselves or their family members living in the same residence, provided that they are not disclosed to third parties and that obligations regarding data security are complied with.

  • Processing of personal data for purposes such as research, planning and statistics by anonymizing them with official statistics.

  • Processing of personal data for artistic, historical, literary or scientific purposes or within the scope of freedom of expression, provided that it does not violate national defence, national security, public security, public order, economic security, privacy of private life or personal rights or constitute a crime.

  • Processing of personal data within the scope of preventive, protective and intelligence activities carried out by public institutions and organizations authorized by law to ensure national defence, national security, public safety, public order or economic security.

  • Processing of personal data by judicial authorities or enforcement authorities in relation to investigation, prosecution, trial or execution proceedings.

       Exercise of Rights by Data Owners

  • Data owners can use the “Form for Applications to be Made by Personal Data Owners to the Data Controller” available at the link [ www.changeqr.com ] to exercise the above-mentioned rights .

  • Applications will be made using one of the following methods, together with documents that identify the relevant data owner:

  • The form must be filled out and a signed copy must be delivered by hand, via a notary, or by registered mail to the address given by the site owner.

  • Signing the form with the secure electronic signature issued within the scope of the Electronic Signature Law No. 5070 and sending it via registered e-mail,

  • Following a method prescribed by the Personal Data Protection Board.

  • The Company responds to data owners who wish to exercise their rights within the limits set forth in the Law, within a maximum of thirty (30) days, as stipulated in the Law. In order for third parties to request an application on behalf of personal data owners, the data owner must have a special power of attorney issued through a notary on behalf of the person making the application.

  • Although data owner applications are processed free of charge as a rule, charges may be made based on the fee schedule[1] prescribed by the Personal Data Protection Board.

  • The Company may request information from the relevant person in order to determine whether the applicant is the personal data owner, and may ask questions to the personal data owner regarding his/her application in order to clarify the issues specified in the application.

[1] According to the “Communiqué on the Procedures and Principles of Application to the Data Controller” published in the Official Gazette dated 10.03.2018 and numbered 30356, if the data owner’s application is to be answered in writing, no fee will be charged for up to ten pages. A processing fee of 1 Turkish Lira may be charged for each page over ten pages. If the answer to the application is given on a recording medium such as a CD or flash memory, the fee that may be requested by the Institution cannot exceed the cost of the recording medium.
